The prevailing laws and regulations also stipulate the methods and procedures of obtaining land areas for development of palm plantations (Figure 3). In general, the land areas for plantations (and also for other sectors) are derived from areas of cultivation and forested areas.<\/p>\n<p><span style=\"font-size: 18px;\"><strong>Figure 3. Procedures and Mechanisms of Procuring Lands for Palm Plantations In Indonesia<\/strong><\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/i0.wp.com\/gapki.id\/dir-site\/uploads\/2024\/12\/DATA_gambar3_prosedur_tahapan_mekanisme_.webp?resize=466%2C563&amp;ssl=1\" width=\"546\" height=\"660\" \/><\/p>\n<p>Procedures and Stages of the Mechanism of Acquiring Land for Oil Palm Plantations in Indonesia.<\/p>\n<p>Based on Law No.11\/ 2020 on Job Creation and Law No. 41 of 1999 on forestry, the conversion of forests into non-forest areas, including plantations, is only allowed on production forests that can be legally converted (convertible forests). But the \u00a0protected and conservation forests are not allowed to be converted to other non-forest functions (unconvertible forests).<\/p>\n<p>The authority to determine and grant permits for the release of the production forests that can be converted into non-forest functions lies with the ministry of forestry. Likewise, the authority to issue Plantation Location Permits (after the Area Release Decree is issued) and Plantation Business Permits-IUP (after the Location Permit is issued) in accordance with the Plantation Law and the Regional Government Law lies with the Regent (in one regency) or Governor (if located in more than one regency).<\/p>\n<p>After obtaining the IUP, one can apply to obtain the Right to Cultivate (HGU) for oil palm plantations to the ministry of spatial planning and national land agency (ATR\/BPN).<\/p>\n<p>It should be stated that regulations on land acquisition and plantation permits have long been ruled through the Decree of the Minister of Agriculture starting from the Decree of the Minister of Agriculture No. 325\/Kpts\/Um\/5\/1982 concerning Licensing Procedures for the Plantation Subsector, which has been updated several times until the Regulation of the Minister of Agriculture No. 21 of 2017 on Guidelines for Plantation Business Licensing. With such procedures, stages, and mechanisms for acquiring plantation land, it is very clear that only the government through all of its institutions which has the authority to allocate land for plantations.<\/p>\n<p>By common sense, it is impossible for oil palm growers to acquire the forest areas or land areas carelessly as they are subject to the prevailing regulations in Indonesia. In fact, with such multi-level land acquisition procedures, stages and mechanisms involving cross-institutions, the government wants to prevent careless use of land areas.<\/p>\n<p>The description above shows that there are regulations and governance that must be followed by business players in obtaining lands for oil palm plantations in Indonesia. If in reality the oil palm growers do not comply with the established procedures, then it is clear that they must be prosecuted in accordance with the prevailing regulations and laws.
